Procedure for Filing and Registration

Briefly, the procedure for filing and registration of a claim is as follows:

(a) Every claim shall be made in Form 1 which can be obtained free from the Tribunal’s office at the addresses listed from page 11.

(b) Form 1 must be completed in 4 copies by the claimant and filed in the nearest office of the Tribunal:

(c) The filing fee for Form 1 is RM5.00 and an official receipt will be issued to the claimant:

(d) Form 1 will be registered dated and signed by the Secretary or an Assistant Secretary of the Tribunal and affixed with the seal of the Tribunal. Two copies of Form 1 that have been affixed with the seal of the Tribunal shall be returned to the claimant for service:

(e) Service of Form 1 to a respondent may be affected in any of the following manner: 

In the case of an individual

      (i)  leaving the document with that person: or

      ii)  giving the document to that person; or

      iii) posting the document in a pre-paid registration letter addressed to that person at his address for service or his last known address.


In the case of a company or a firm :

      i)   leaving the document with the director, manager, secretary or other similar officer of the company or the  proprietor of the firm;

      ii)  giving the document to any of the persons mentioned above; or

      iii) posting the document in a pre-paid registered letter addressed to any of the persons mentioned above at the registered office of the company or firm or at its address for service.

(f) A respondent who receives a sealed copy of Form 1 from the claimant shall, if he disputes the claim, file his defense or defense and counter-claim (if any) in Form 2 which can be obtained free from the Tribunal’s office.

(g) Form 2 must be filed in 4 copies at the same Tribunal’s office where Form 1 was filed within 14 days after the receipt of Form 1 by the respondent:

(h) The filing fee for Form 2 is RM5.00 and an official receipt will be issued to the respondent;

(i) Form 2 will be registered, dated and signed by the Secretary or an Assistant Secretary of the Tribunal and affixed with the seal of the Tribunal. Two copies of Form 2 that have been affixed with the seal of the Tribunal shall be returned to the respondent for service of one copy to the claimant in accordance with paragraph (e)

(j) A claimant who receives a sealed copy of Form 2 shall file his defense to a counter-claim (if any) in Form 3 which can be obtained free from the Tribunal’s office;

(k) Form 3 must be filed in 4 copies at the same Tribunal’s office within 14 days after the receipt of Form 2 by the claimant.  There is no filing fee for Form 3.

(l) Form 3 will be registered, dated and signed by the Secretary or an Assistant Secretary of the Tribunal and affixed with the seal of the Tribunal. Two copies of Form 3 that have been affixed with the seal of the Tribunal shall be returned to the claimant for service of one copy to the respondent in accordance with the paragraph (e).
